CONSIGNMENT AGREEMENT
This agreement is between Boat Shop, Inc. and_________________________________(consignor).
The consignor does hereby consign the snowmobile defined herein, to Boat Shop, Inc., 1050 Chena Pump Rd., Fairbanks, Alaska 99709, for the purpose of resale of said snowmobile.
The consignor agrees that he/she will:
.... 1) Maintain insurance on the snowmobile to provide against theft, fire damage, loss due to acts of nature, or loss of any other kind, while the consigned snowmobile
is in the possession of Boat Shop, Inc.
.... 2) Continue to make the required scheduled payments (due to a financial institution)
as well as maintaining insurance coverage on the snowmobile described herein.
Boat Shop Inc. will receive:
.... 1) Twelve-percent (12%) sales commission of
the total sales amount of said snowmobile.
.... 2) A minimum
consignment fee of $250.00 will apply to snowmachines and/or trailers.
From the proceeds of the sale, the consignor agrees he/she is willing to accept the gross amount of ________________________, less the amount due to the lienholder (if any) on said snowmobile, as his/her portion of the proceeds from the sale of the snowmobile listed herein. Boat Shop, Inc. agrees to obtain permission from the consignor if a change in the consignment amount listed above requires adjustment, to allow a better selling opportunity, for the sale of the snowmobile listed herein. Permission may be obtained in written or verbal form via telephone.
All snowmobiles will be set up with “Fairbanks jetting”. If not already installed, a “service charge” of 1/2 hour shop time ($42.50) and a parts fee of $3.00 per jet installed, will be charged to the consignor, in the event Boat Shop, Inc. has to install the correct jetting.
A $100.00 flooring charge will incur if the consignor
resumes possession of said snowmobile, prior to Boat Shop, Inc. selling
snowmobile. The flooring charge will be waived should said snowmobile
be sold by Boat Shop, Inc. The flooring charge covers, but is not limited
to, most aspects of trying to sell the consignor's snowmobile. (I.E.
advertising, detailing, displaying, etc.) Snowmobiles not sold within a
reasonable period of time (which shall be defined by the staff of Boat
Shop, Inc.) will need to be picked up by the consignor, at Boat Shop,
Inc.'s request. The $100.00 flooring charge will still apply and is due at
the time of snowmobile pick up before the consignor resumes possession of
said snowmobile.
